PUBLIC NOTICE PUBLIC NOTICE OF MORTGAGE FORECLOSURE SALE Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Johnny R. Rogers and Theresa J. Burston, unmarried, in favor of First Community Bank of Central Alabama, on the 16th day of June, 2016, said mortgage recorded June 24, 2016, in the Office of the Judge of Probate of Elmore County, Alabama, in Real Property Book 2016 at Page 29491 (the "Mortgage"), and, pursuant to the laws of the State of Alabama, the undersigned First Community Bank of Central Alabama, under and by virtue of the power of sale provision and other terms contained in said Mortgage, elects to declare the entire indebtedness secured by said Mortgage due and payable, and will sell at public outcry to the highest bidder, for cash, in front of the main entrance of the Courthouse of Elmore County, Alabama, at 100 East Commerce Street, Wetumpka, Alabama, 36092, during the legal hours of sale on October 2, 2019, all of its right, title, and interest in and to the following described real estate, situated in Elmore County, Alabama, to-wit: Lot 3 of Cherokee Trail Subdivision as the same is recorded in the Office of the Judge of Probate of Elmore County, Alabama in Plat Book 12 at Page 83. Also conveyed are easements of rights for access and utilities along across over and under that 30 feet wide access and utility easement shown on the plat of Cherokee Trail Subdivision as recorded in Plat Book 12, Page 83 in the office of the Judge of Probate of Elmore County, Alabama which lies along the South boundary of Lot 2 of such subdivision. This conveyance is also made subject to such 30 feet wide access and utility easement as shown on such plat as it affects Lot Number 3. This mortgage does not include mobile home. The property is located in Elmore County at 2.59 acres +/- located on Burston Drive, Tallassee, Alabama 36078. Said foreclosure sale and conveyance incident thereto are subject to the legal rights of any existing federal tax liens, special assessments, easements, restrictions, and reservations appearing of record.
