ORDINANCE

2013 – 4

AN ORDINANCE OF THE CITY OF

WETUMPKA,

ALABAMA TO ABOLISH

THE CHRISTMAS ON THE COOSA BOARD AND THE SPECIAL

OCCASION BOARD

BE IT ORDAINED by the Council of the City of Wetumpka, Alabama, as follows: WHEREAS, there was a time during which the City was best served by the volunteer members of this two boards; and WHEREAS, the City Council is very thankful for the service of the many members who have served on this two Boards and gave their time and efforts to better the City of Wetumpka; and

WHEREAS, the City Council has now determine that it would be advisable to establish new procedures to consolidate the planning and coordination for all seasonal celebrations, special events and entertainment to be conducted in the City.

NOW, THEREFORE BE IT RESOLVED by the Council of the City of Wetumpka, as follows:

SECTION 1. The Christmas on the Coosa Board as defined in the Wetumpka Code of Ordinances Section 2 – 101 – 109 and the Special Occasions Board as defined in the Wetumpka Code of Ordinances Section 2- 141 – 149 are both hereby abolished; the Boards’ term of existence are revoked in accordance with Ordinances establishing the Boards; and all such code sections herein delineated are hereby repealed.

SECTION 2. Any former ordinance conflicting with the provisions of this ordinance is hereby repealed.

SECTION 3. If any provision of this ordinance shall be declared unconstitutional, or otherwise invalid, it shall have no effect on the remaining provisions of this ordinance.

SECTION 4. This ordinance shall become effective upon the adoption and publication as required by law.

WHEREAS, a Petition signed by the owners of all of the lands abutting the following described street, situated in the City of Wetumpka, County of Elmore, State of Alabama, requesting the vacation of said street, has been duly presented to the City Council of the City of Wetumpka, Alabama, for the assent and approval of said governing body, said Petition with map attached being hereto affixed, marked Exhibit A and made a part hereof; and,

WHEREAS, pursuant to Section 23-4-2 of the Code of Alabama 1975 notice of said request for vacation was published and a hearing was held on the 1st day of April, 2013, at the Wetumpka City Hall, 212 South Main Street, Wetumpka, Alabama; and,

WHEREAS, said scheduled meeting was advertised in the Wetumpka Herald for four successive weeks, to wit March 2, 2013; March 9, 2013; March 16, 2013; and March 23, 2013; and, WHEREAS, notice of the scheduled meeting was posted on the bulletin board of the County Courthouse for the same period of time covered by the newspaper publication, and;

WHEREAS, a copy of the notice of said meeting was also served by U.S. mail at least thirty days prior the scheduled meeting on all abutting landowners and all entities known to have facilities or equipment within the public right-of-way sought to be vacated; and,

WHEREAS, in accordance with the said notice, a public hearing was held on the date and time aforesaid wherein proponents and opponents were given the opportunity to speak on the vacation issue; and,

WHEREAS, it appears to the City Council of the City of Wetumpka, Alabama, that the vacation of said street is in order and that convenient and reasonable means of ingress and egress is afforded to all other property owners owning properties; and,

WHEREAS, a Motion to Approve the Vacation was made by the City Council Representative in whose district the portion of said public alley to be vacated is located; and,

WHEREAS, said motion carried unanimously; and,

NOW THEREFORE, the City of Wetumpka finds that no entity or person will be cut off from nor denied access to their property by the vacation of said the street but to the contrary, all other entities and persons already have reasonable and convenient access to their properties; and,

BE IT FURTHER RESOLVED, by the City Council of Wetumpka that it is in the best interest of the public that such portion of Fish Street as hereinbefore described be vacated; and,

BE IT FURTHER RESOLVED, by the unanimous consent by the City Council of Wetumpka that the portion of Fish Street described in Exhibit A attached hereto be and the same hereby is vacated and divested of all public rights and liabilities, including any rights which may have been acquired by prescription, and that title to the below described portion of Fish Street is now vested in Price Publications subject to the right of entities with utilities in place at this time to continue to maintain, extend, and enlarge their lines to the same extent as if the vacation had not occurred, pursuant to the provisions of Section 23-4-20 of the Alabama Code of 1975; and,

BE IT FURTHER RESOLVED, that this resolution shall be recorded in the Office of the Judge of Probate of Elmore County, Alabama, and further that it shall be published once in a newspaper in the county no later than fourteen (14) days from this date.
